Terms of Service — Artworld
Version: Beta 1.0 — June 1, 2026
BETA NOTICE: Artworld is an experimental, pre-commercial platform provided for testing and evaluation purposes. All features are provided strictly "as-is." No guarantees are made regarding availability, functionality, data retention, or continuity of service. By using Artworld, you acknowledge and accept these conditions fully.
1. About Artworld
Artworld ("Platform," "we," "us," "our") is an online platform for artists to showcase, manage, and explore artworks and galleries, accessible at artworld.one.
The Platform is currently operated as a beta startup project by Artworld Project. It has not yet been incorporated as a legal entity. These Terms will be updated to reflect legal entity details once established. For all inquiries: support@artworld.one
2. Acceptance of Terms
By accessing or using the Platform in any way — including browsing, registering, or uploading content — you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy.
If you do not agree, you must stop using the Platform immediately.
We may update these Terms at any time by publishing the updated version at artworld.one/terms with a revised "Last updated" date. Your continued use of the Platform after any update constitutes your full acceptance of the new Terms. If you do not accept updated Terms, you may delete your account and stop using the Platform at any time — that is your sole remedy.
3. Eligibility
You must be at least 16 years old to register and use the Platform. By creating an account, you confirm that you meet this requirement.
If you are between 16 and 18 years old, you confirm you are permitted to enter into binding agreements under the laws of your jurisdiction.
We do not knowingly collect data from users under 16. If we learn a user is under 16, we will delete the account and all associated data without notice.
4. Account Registration
You must provide accurate registration information. You are solely responsible for:
- Maintaining the confidentiality of your credentials;
- All activity that occurs under your account;
- Notifying us at support@artworld.one of any unauthorized access.
One account per person. Creating multiple accounts to circumvent bans, limits, or restrictions is prohibited and may result in permanent suspension of all accounts.
You may register using email/password or via third-party providers (currently Google OAuth; Apple Sign-In coming soon). When using third-party authentication, that provider's own terms and privacy policy also apply to you independently of these Terms.
5. Your Content — License and Responsibility
5.1 You Retain Your Rights
You retain all intellectual property rights in content you upload ("Content"). By uploading Content, you grant Artworld a worldwide, non-exclusive, royalty-free license to store, process, display, and reproduce your Content solely for the purpose of operating the Platform. This includes: displaying artworks publicly (per your visibility settings), generating image variants (WebP processing), running AI analysis at your request, creating 3D gallery previews, and showing thumbnails.
This license ends when you delete the Content or your account (subject to our data retention policy).
5.2 You Are Solely Responsible
Artworld does not pre-screen, verify, or actively monitor user Content. You are solely and fully responsible for everything you post. You warrant that:
- You have the legal right to upload and display the Content (see Section 6);
- Your Content does not infringe any third-party copyright, trademark, privacy, or other rights;
- Your Content complies with all applicable local, national, and international laws.
If a third party brings a claim against Artworld arising from your Content, you agree to indemnify and hold Artworld harmless from all resulting costs, damages, and losses.
Artworld acts as a passive hosting provider. We are not responsible for user-generated Content and claim the benefit of all applicable hosting safe harbor protections (including EU DSA Article 6 and equivalent).
6. Content Policy — What You May and May Not Post
6.1 Permitted Content
You may post Content only if one of the following applies:
- You are the original creator (copyright holder) of the work — including works you have previously sold (artists retain copyright after a physical sale unless explicitly transferred in writing); or
- You are a gallery or institution that physically owns the original artwork and holds the necessary rights to display it digitally; or
- You have explicit written authorization from the copyright holder to display the work on the Platform.
6.2 Strictly Prohibited Content
The following is not permitted under any circumstances:
- Works you did not create and do not have authorization to display;
- Sexually explicit, pornographic, or obscene material;
- Content depicting, glorifying, or promoting violence, abuse, self-harm, or illegal acts;
- Content featuring minors in any harmful, sexualized, or exploitative context;
- Content that violates any applicable law in any jurisdiction;
- Spam, unsolicited commercial content, or misleading or fraudulent material;
- Content that impersonates any person, entity, or brand;
- Any content that violates Platform rules as updated from time to time.
Violation of this section may result, at our sole discretion, in content removal, account suspension, or permanent ban without prior notice or refund.
7. Artworks, Prices, and Transactions
7.1 Informational Platform Only
Artworld is an informational platform only. We are not a marketplace, broker, dealer, or auction house. We do not buy, sell, broker, or facilitate the transfer of any artwork or goods. We do not process payments for any artwork transaction.
7.2 Prices Are Set Entirely by Artists
Any price displayed on the Platform is set exclusively by the artist or gallery. Artworld has no involvement in pricing, valuation, or negotiation. We make no representation about the accuracy, fairness, or market value of any listed price.
7.3 Physical Artwork May Differ from Photography
Artworks are represented solely by photographs uploaded by users. The actual physical artwork may differ from its photographic representation in color, texture, tone, size, condition, framing, or any other respect. Photographs may be affected by lighting, camera calibration, screen rendering, and other factors outside our control.
Artworld makes no representations regarding the accuracy of artwork photography. Any purchase decision based on Platform listings is made entirely at the buyer's own risk.
7.4 All Transactions Are Between Buyers and Artists Only
The Platform may allow interested buyers and artists to discover each other. Any negotiation, agreement, payment, or delivery arrangement takes place exclusively between the buyer and the artist. Artworld is not a party to any such transaction and accepts zero liability for:
- Any transaction, payment, delivery failure, or dispute;
- The quality, authenticity, condition, or provenance of any artwork;
- Any misrepresentation by either party;
- Any financial loss arising from a buyer-seller relationship.
We strongly recommend that all parties perform independent due diligence before entering any transaction.
8. AI Features
The Platform includes AI-powered features (artwork description generation, style tagging, scene analysis) powered by Google Gemini AI.
These features are:
- Provided as-is, with no guarantee of accuracy, quality, or fitness for any purpose;
- Dependent on third-party infrastructure — availability may be interrupted at any time;
- Subject to usage limits that may change without notice;
- Available only up to the limit shown in your account settings.
When you use AI features, your artwork image is transmitted to Google's servers for processing (see Privacy Policy §5). AI-generated output is a suggestion only and does not constitute expert appraisal, authentication, certification, or valuation.
9. Paid Plans
The Platform may introduce paid subscription plans. If and when paid plans are available, they may include — without limitation — higher usage limits (artworks, galleries, 3D galleries, AI feature usage, storage), access to additional 3D room designs, higher-quality AI tools for image editing and text generation, and other features as described at time of purchase.
Paid plans:
- Are offered strictly as-is, with no guarantee of uninterrupted access, feature continuity, or specific results;
- May be modified at any time — specific features may be added, changed, or removed;
- Are described at artworld.one at the time of purchase; current feature listings are non-binding commitments and may change;
- No refund is guaranteed, except where required by applicable law (e.g., EU consumers' statutory 14-day withdrawal right for digital services, which is not waived by these Terms).
We reserve the right to modify, suspend, or discontinue any paid plan at any time with reasonable prior notice. Your only remedy for dissatisfaction with a paid plan is to cancel it.
10. Reports and Moderation
10.1 How to Report
If you believe any Content on the Platform violates these Terms, your intellectual property rights, or applicable law, you may:
- Use the Report button available on artwork and profile pages; or
- Email support@artworld.one with a description of the issue.
10.2 Our Discretion — No Guarantees
We review all reports at our sole discretion. We do not guarantee:
- Any specific response time;
- That all reports will be reviewed or acted upon;
- Any particular outcome or enforcement action.
We reserve the right to decline to act on a report if:
- The alleged violation cannot be confirmed by us;
- The report does not include sufficient contact information to allow follow-up;
- The report is anonymous, vague, incomplete, or lacks a clear description of the violation;
- We determine in our sole judgment that the report does not constitute a genuine violation.
10.3 Copyright Takedown (DMCA / DSA)
If you believe your copyrighted work has been posted without authorization, send a notice to support@artworld.one including: your contact details, identification of the copyrighted work, its location on the Platform, and a good-faith statement that the use is unauthorized.
We will assess valid takedown notices in a reasonable timeframe but make no commitment as to timing.
10.5 Social Features (Planned)
The Platform may introduce social features such as likes, follows, and public comments. When available, any public interaction you perform (liking a work, following an artist, posting a comment) will be visible to other users and associated with your public profile.
We will update these Terms before any social features are publicly released.
11. Third-Party Services
The Platform integrates with third-party services including:
- Google OAuth — authentication; governed by Google's Terms of Service and Privacy Policy;
- Apple Sign-In (coming soon) — authentication; governed by Apple's Terms and Privacy Policy;
- Google Gemini AI — AI artwork analysis; your artwork image is processed by Google;
- Cloud infrastructure (storage, compute, image processing) — see Privacy Policy.
Artworld is not responsible for the availability, accuracy, or data practices of any third-party service. Use of third-party services through or in connection with the Platform is entirely at your own risk.
12. No Warranty — "As-Is" Service
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE PLATFORM IS PROVIDED "AS-IS" AND "AS-AVAILABLE" WITHOUT ANY WARRANTY OF ANY KIND.
We expressly disclaim all warranties, express or implied, including but not limited to:
- Uninterrupted, timely, secure, or error-free operation;
- Fitness for any particular purpose;
- Accuracy or completeness of any content, feature, or result;
- That defects, errors, or bugs will be corrected;
- That the Platform will be available at any particular time.
As a beta platform under active development, features may be added, changed, broken, removed, or permanently discontinued at any time. Data may be lost. This is an inherent and accepted risk of using a beta product.
Scheduled or unscheduled downtime may occur without notice.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
Artworld and its team members, contributors, and operators shall not be liable for any:
- Indirect, incidental, special, consequential, exemplary, or punitive damages;
- Loss of data, revenue, profits, goodwill, or business opportunities;
- Damages arising from service interruption, data loss, unauthorized access, or Platform defects;
- Damages arising from transactions, disputes, or relationships between users;
- Damages arising from reliance on AI-generated content.
Our total aggregate liability for any claim arising from your use of the Platform shall not exceed the greater of: (a) the total amount you paid to Artworld in the 12 months prior to the claim, or (b) €10 EUR.
Nothing in these Terms excludes or limits liability for: death or personal injury caused by our gross negligence; fraud or fraudulent misrepresentation; or any liability that cannot be excluded or limited under applicable law.
Consumers in the European Union retain statutory rights that cannot be waived by contract.
14. Account Termination
By you: You may delete your account at any time via account settings or by contacting support@artworld.one. Upon deletion, your data will be removed per the Privacy Policy.
By us: We reserve the right to suspend or permanently terminate any account at any time, for any reason or no reason, including but not limited to violation of these Terms. We will attempt to notify you but are under no obligation to do so. No refund is owed upon termination for cause.
Upon termination, your license to use the Platform ends immediately. We are not liable for any loss of Content or data following account termination.
15. Governing Law and Disputes
As the Platform is not yet incorporated, the applicable governing law will be specified upon legal entity establishment. This section will be updated accordingly.
If you are a consumer in the European Union, you retain the right to bring claims in the courts of your country of residence and to use the EU Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr

16. General Provisions
- Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and Artworld regarding the Platform.
- Severability: If any provision is found invalid or unenforceable, the remaining provisions remain in full effect.
- No Waiver: Failure by Artworld to enforce any provision does not constitute a waiver of that or any other provision.
- Language: These Terms are provided in English. If a translation is made available, the English version governs in the event of any conflict.
